Trust Litigation
Our client and his sister are equal
beneficiaries of their late father’s estate,
valued at more than 2 million dollars. The
sister is trustee and unilaterally paid herself
an excessive trustee fee, filed inaccurate
estate tax returns causing the estate to incur
tax penalties and interest, and has refused to
provide a full and complete accounting of the
trust estate. Sax filed a petition with the Napa
County Probate Court to Compel the sister to
provide an accounting and to have her removed as
trustee for her breaches of the trust. This
matter is currently in litigation.
Mortgage Loan Fraud
Sax represented the plaintiff in this matter.
Defendants arranged predatory loans on
plaintiff's long-time home. Plaintiff loaned
$450,000.00 of his home equity to defendants,
extinguishing all of the equity that he had
built up over the years in which had been
unencumbered before defendants took advantage of
and unscrupulously profited from plaintiff's
lack of sophistication, vulnerability, age and
poor education. This was an eleven (11) day Jury
Trial. The Jury awarded plaintiff $380,000.00
which includes Punitive Damages. Defendants have
filed Motions to Amend the Verdict.
Financial Fraud
Sax represents the plaintiff in this matter.
Plaintiff and defendants entered into an
agreement at Rohnert Park, California, that
defendants would invest $300,000.00 of
plaintiff’s money in oil and gas ventures. One
of them was plaintiffs CPA who failed to
disclose her conflict of interest. Defendants
committed fraud. This matter is currently in
litigation.
Construction Defect
Sax represents the plaintiffs. Plaintiffs filed
a lawsuit against a home builder and allege
their new construction home was not properly
constructed as manifested by numerous serious
defects which have resulted in major damage to
the home and its contents and mold
contamination. Plaintiffs have incurred
substantial financial costs and suffered
physical ailments from the construction defects.
This matter is currently in litigation.
Premises Liability
Sax represents the plaintiff in this matter. On
February 11, 2009 defendant invited plaintiff to
walk up on a scaffolding defendant had built at
the second story level of the barn. When
plaintiff stepped onto the scaffolding it
collapsed because it was constructed improperly.
Plaintiff fell to the ground. Plaintiff
sustained a left ankle fracture and broken ribs.
These were serious injuries with permanent
residuals. Plaintiff has had two (2) surgeries
so far regarding his broken ankle at Kaiser
Hospital. Plaintiff will probably require
surgery in the future to remove or repair the
remaining screws in his ankle. Plaintiff was
awarded $150,000.00.
Auto Collision Serious Injuries
Sax represents plaintiff. On October 6, 2009,
plaintiff was rear ended by defendant. Defendant
was traveling eastbound on Sonoma Highway
approaching the stopped traffic. Defendant’s
cell phone rang and he looked down toward it.
When defendant looked back to the roadway, he
noticed the stopped traffic. He attempted to
avoid the collision by braking. The front end of
defendants Toyota collided into the rear of the
Lexus, driven by plaintiff. In turn, the front
end of the plaintiff’s car collided into the
rear of the Nissan. As a result of the motor
vehicle accident, plaintiff suffers from a
permanent low grade chronic pain syndrome and
some traumatic brain injuries. Prior to this
accident, plaintiff was a highly successful
business woman and high income earner. This
matter is currently in litigation. Sax will
demand policy limits of $100,000.00 from driver
then pursue underinsured benefits for plaintiff.
Property Support
Sax represents wife. Involves divorce with an
elderly couple and division of a 2 million
dollar estate including multiple homes, several
retirement accounts including military
retirement, and multiple investment accounts.
Husband was uncooperative. Sax Law Firm brought
case to settlement conference and negotiated
settlement without the need for a trial. May
need to pursue undisclosed assets.
Case still in litigation. Sax represents Husband
in divorce involving large community property
estate including multiple residences, retirement
funds, inheritance funds, and investment
accounts. Successfully mediated case with
private mediator rather than taking case to
trial.
Child Custody and Child Visitation
Sax represents Father of two young children.
Helped Father to obtain a 50/50 custody and
visitation schedule with toddler and infant
children after only one mediation session and
court hearing.
Sax represented Father in child custody and
visitation matter. Our office took this matter
to a settlement conference and settled the
entire action rather than sending the parties
through an expensive and time consuming child
custody evaluation or trial.
Child Custody, Child Visitation and Child
Support
Sax represented a Father of two teenage
children. Helped Father to obtain sole custody
of children due to children’s absence and
tardiness in school while in Mother’s custodial
care and Mother’s unstable living conditions.
Auto Accident
Sax represents plaintiff. On April 8, 2009
defendant was driving on I-80 eastbound west of
Travis Boulevard at 40-50 mph directly behind
Plaintiff. Plaintiff was driving on I-80
eastbound west of Travis Boulevard at a complete
stop due to traffic ahead of him. Due to
defendant’s unsafe speed, defendant was unable
to stop his vehicle and hit the rear of
Plaintiff's vehicle.
Plaintiff has suffered injuries to his neck and
back. Past medical expenses are approximately
$17,417.00. Wage loss and future medical
expenses are unknown. This matter is currently
in litigation.
Dog Bite
Sax represented the plaintiff in this matter. On
October 6, 2009 Plaintiff rescued her dog from a
vicious attack by the defendant’s pit bull and
sustained a SLAP lesion and chondral fracture of
the humeral head with loose body in her right
shoulder. Plaintiff had arthroscopic surgery on
her shoulder. Plaintiff also sustained dog
bites, scratches and emotional distress from the
incident. Defendant knew that his pit bull had
vicious propensities. Nevertheless defendant
decided to let his pit bull off its leash and
the pit bull attacked plaintiff and her dog, the
injuries to plaintiff’s dog were horrible. The
attack by defendants pit bull was unprovoked by
any dog or person. The dog attack has brought
great disruption to the life of plaintiff.
Plaintiff is a registered nurse. The injuries
made it impossible for her to work without pain
before the surgery and impossible to work for
six and a half months after the surgery. Prior
to the dog attack plaintiff was extremely
active. Plaintiff has been advised that she will
probably suffer from arthritis in the future in
her right shoulder and will probably require
future surgery. Plaintiff was awarded
$275,000.00 at Mediation.
